Red flags
Conflicts and concerns
CHS sued at least 19,000 of its own patients during the first 14 months of the pandemic.
The HMA settlement included a guilty plea by a CHS subsidiary for conspiracy tied to admitting emergency patients who did not need a bed.
A 2014 breach exposed 6.1 million people and cost $7.3 million in federal and state settlements.
The company is selling hospitals to pay down $9.6 billion of debt while losing money on the ones it keeps.
Physician-owned hospitals
CHS is the clearest case of what the POH ban protects: a highly leveraged chain that cannot compete and is selling hospitals to survive. Its buyers in 2025 and 2026 were nonprofit systems, Duke, Vanderbilt, AdventHealth and Ascension, never physicians, because physicians cannot own a Medicare hospital. Lifting the ban would create a second class of buyer for the hospitals CHS still has to sell.
